E-Filing Pioneer Judge, James Mehaffy, Jr. Passes

A couple of weeks back we learned that retired Texas District Court Judge James Mehaffy, Jr. had passed away.

I had the honor of knowing and working with the Judge and visiting his court in Beaumont, Texas.  In the early 1990’s the NCSC had both the Court Technology Laboratory and Courtroom 21 projects running in Williamsburg.  Judge Mehaffy brought a team from his court that was planning on how to deal with a very large and complex series of civil trials.  At the time the plan was to convert the jury assembly room of the courthouse into a courtroom to handle the large number of lawyers who would be present.

The Nevada Administrative Office of the Courts (AOC), a judicial branch department that assists the Supreme Court of Nevada with the administration of the Nevada courts, invites submissions of offers for systems and services for a statewide cloud‐based, COTS electronic filing system, a document access system, a redaction component, and a forms assembly solution (“eFiling system” or “Solution”). West Virginia Issues RFP for CMS/EDMS/E-Filing

  

The Supreme Court of Appeals of West Virginia is issuing a Request for Proposal (RFP) to acquire an electronic court case management solution comprised of case management, document management, and e-file management systems for the new Intermediate Court of Appeals created in 2021 by the West Virginia Legislature.  

The initial focus of the project will be on the new court with the possibility of future expansion to other levels of the West Virginia Judiciary. The deadline for submission is October 1, 2021. Some Ideas for Handling the Upcoming Covid-19 Case Surge

 


Everyone can easily foresee the surge of in-person court cases that are coming later in 2021.  Many courts have put case processing on hold.  And assuming that the vaccination program will be successful in the first half of the year, what can courts do to address the case backlog and new matters that will come?  I have some ideas that I will share below.

Like the Reese’s Peanut Butter Cup commercial with the tag line “you got chocolate in my peanut butter” there is a great potential synergy between A2J/ODR and court E-filing. Specifically, did you know that the Oasis-Open LegalXML Electronic Court Filing 5.0 standard could be used as an interface into the court’s data by Access to Justice (A2J) and ODR systems?  More below.

E-Filing Gets Serious in New Jersey

We learned from a Law.com article that the New Jersey Appellate Court had affirmed an order enforcing an arbitration award after the plaintiff’s lawyer “failed to use New Jersey’s eCourts system to electronically file its demand for a trial de novo and to pay the filing fee”.  Discussion follows below.

LegalXML Electronic Court Filing 5.0 Standard Approved


OASIS is pleased to announce that Electronic Court Filing Version 5.0 (ECF) from the OASIS LegalXML Electronic Court Filing Technical Committee [1] has been approved as an OASIS Committee Specification.  (ed note: the committee has been working on this for years BTW.)

ECF defines a technical architecture and a set of components, operations and message structures for an electronic court filing system, and sets forth rules governing its implementation. Version 5.0 provides a number of enhancements including:
