LegalXML E-Filing Standard and A2J/ODR

Like the Reese’s Peanut Butter Cup commercial with the tag line “you got chocolate in my peanut butter” there is a great potential synergy between A2J/ODR and court E-filing. Specifically, did you know that the Oasis-Open LegalXML Electronic Court Filing 5.0 standard could be used as an interface into the court’s data by Access to Justice (A2J) and ODR systems?  More below.

 The LegalXML ECF standard is being used in many (but unfortunately not all) court E-filing systems.  The benefit, of course, is that the Electronic Filing Manager part of the system can literally serve as the safe connection between external and internal data systems.  Texas has specifically shown that implementing EFM in the middle between EFSP’s (electronic filing service providers) and hundreds of courts facilitate an entire communication ecosystem.

But LegalXML ECF can do more.  It has provisions for querying case management systems for the status of case matters and retrieve documents.  The list of documents/registered events can also be queried and retrieved.  And it could request a hearing or similar event to be scheduled by the court.

So, what I am saying is that the “front end” A2J systems can not only prepare documents for the court, they can be built to interact with the court to further guide their users.  In the same vein, ODR hopefully handles many disputes within their systems but what happens when it can’t.  ECF can smooth the way for filing and interacting with the court It is something to think about?
